Insurance Terms and Conditions

By default, all shipments are not insured. WIL Shipping and all Forwarders/NVOCC/Carriers involved are free of any responsibility in case of damage, loss, or theft of any kind.

Unless requested to do so in writing and confirmed to Customer in writing and prepaid in full; WIL Shipping is under no obligation to procure insurance on Customer’s behalf.

WIL Shipping strongly encourages that the shipper or consignee purchase an insurance policy for the shipment from an insurance company to cover for any losses.

WIL Shipping can assist by purchasing an insurance policy for the shipment from a third-party insurance provider. But unless requested to do so in writing and confirmed to the customer in writing, WIL Shipping is under no obligation to procure insurance on the customer’s behalf. Customer shall pay premiums and costs in connection with procuring requested insurance for the insurance policy to be purchased and go into effect.

If insurance is selected: and a claim arises during or after the shipment of the vehicle(s), or cargo, the client acknowledges that claims for damage or other issues will be solely pursued with the insurance provider directly.

WIL SHIPPING retains no legal liability or any other liability for claims arising during or after the shipment of the vehicle(s) or cargo (with or without insurance purchased)

If insurance is not selected:
Customer understand the risks and liabilities for omitting to add maritime insurance on our shipment(s), agree and warrant to hold WIL SHIPPING LLC (the Indemnified Parties) harmless and fully indemnified against all claims, costs and demands of whatsoever nature or amount arising directly or indirectly from the above described shipment and for any breach of any representation or warranty or guarantee made under this agreement.

Customer confirm and warrant that neither him, or any other party, have any further claim against WIL Shipping, their associate or subsidiary companies, their underwriters, agents, and their respective servants and subcontractors, and we release all the foregoing parties from all and any further liability.

The customer authorizes WIL SHIPPING to act on his behalf in arranging transport, receiving, and loading vehicle(s) or cargo for the customer per the bill of lading’s terms and conditions. The customer acknowledges that WIL SHIPPING does not own the subcontracted transportation, carriers ports, airports, and warehousing companies where the services are provided, and does not have control over the quality of the service or delays in pickup, delivery, loading, sailing, or customs clearance. Therefore, WIL SHIPPING will not be held responsible for any damages/losses that may occur during any part of the shipment, or timeliness of delivery.

WIL SHIPPING can provide the client with the transporter, carrier, port/airport or warehouse company name and contact information should an inconvenience result due to the transportation or loading. Although WIL SHIPPING will use reasonable efforts to check coverage and registration supplied by the subcontracted transportation company, it will hold no liability for falsified or counterfeit information provided.

Payment Terms and Conditions

We do not accept cash nor bank deposit. The wire information is strictly for Wire / ACH transfer. Any cash deposit made in the bank will be subject to 10% fee.

Invoices are payable upon receipt and due within 15 days of shipment.

Invoices that remain unpaid after 30 days will be subject to a monthly late payment fee in the amount of $200 and monthly interest at the rate of 33% calculated from the invoice date.

Cargo pertaining to delinquent invoices after 60 days will be considered abandoned and is subject to be auctioned, transferred, or sold to cover for late payment fees, storage charges, transport, and freight. No payment will be due back to the customer regardless of the value of the cargo or the value sold.

The shipper guarantees payment of all collect charges in the event the consignee refuses payment.

Customer must pay all charges in advance unless WIL Shipping LLC agrees in writing to extend credit to Customer; WIL Shipping LLC shall not consider the granting of credit to a Customer in connection with a particular transaction a waiver of this provision.
